Terms & Conditions
Last updated: 8 October 2026
These Terms and Conditions ("Terms") govern your access to and use of the website of The Bigg Pull, presented by Gentle Giant Promotions ("we", "us", "our"), and your participation in related activities. By accessing or using this website, you agree to be bound by these Terms. If you do not agree, please do not use the website.
1. Definitions
"Website" means this website and all its pages and content. "Content" means all text, images, video, graphics, logos and other material on the Website. "You" means any person who accesses or uses the Website.
2. Use of the Website
You may use the Website for lawful, personal and non-commercial purposes only. You may not use it in any way that is unlawful, that could damage, disable, overburden or impair the Website or its security, or that interferes with any other party's use of it. You may not attempt to gain unauthorised access to any part of the Website or its systems.
3. Intellectual Property
All Content on the Website, including the name, logos, branding, text, images, video and design, is owned by or licensed to The Bigg Pull and its partners and is protected by South African and international intellectual property law. You may not copy, reproduce, republish, distribute, modify or use any Content for commercial purposes without our prior written permission.
4. Your Submissions
When you submit content to us, for example a Power Team profile, photographs, comments or an enquiry, you confirm that you own or have the right to share that content, and that it does not infringe the rights of any third party. You grant us a non-exclusive, royalty-free licence to use, reproduce and display that content to record, promote and broadcast the event across our website, live portal and social media, in line with our Privacy Policy. You remain responsible for the content you submit.
5. Donations
Donations made through the Website are voluntary and, unless required by law, are non-refundable. Payments are processed by third-party payment providers whose own terms and conditions apply to the payment transaction. Please ensure your donation details are correct before you submit them. Donations are not investments and do not entitle you to any return, benefit or ownership.
6. Sponsorships, Charities and Partnerships
Sponsorship, charity beneficiary and marketing-partner arrangements are subject to a separate written agreement between you and The Bigg Pull. Any information on the Website about these opportunities is provided as a general guide only and does not constitute a binding offer.
7. Power Team Participation
Participation in the Power Team is subject to a separate participation agreement, waiver and indemnity, which must be signed before taking part. The event is physically demanding and carries inherent risk, which participants accept under that separate agreement.
8. Live Portal and Third-Party Services
Access to the live-streaming portal and any paid services may be subject to their own access, payment and usage terms, which are presented at the point of access. Those terms apply in addition to these Terms.
9. Third-Party Links
The Website may contain links to third-party websites or services that we do not own or control. We are not responsible for their content, products, terms or privacy practices, and access to them is at your own risk.
10. Availability
We aim to keep the Website available and up to date, but we do not guarantee that it will be uninterrupted, error-free or secure. We may change, suspend or discontinue any part of the Website at any time without notice.
11. Disclaimer
The Website and its Content are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we make no warranties or representations, express or implied, about the accuracy, completeness, reliability or fitness for a particular purpose of the Website or its Content.
12. Limitation of Liability
To the fullest extent permitted by law, The Bigg Pull, its organisers, partners, officers and agents will not be liable for any direct, indirect, incidental, special or consequential loss or damage arising out of or in connection with your use of, or inability to use, the Website, or reliance on any Content.
13. Indemnity
You agree to indemnify and hold us harmless against any claim, loss or expense arising from your breach of these Terms, your misuse of the Website, or content you submit.
14. Privacy
Your use of the Website is also governed by our Privacy Policy, which explains how we collect and process personal information in line with the POPI Act.
15. Electronic Communications
When you send us an enquiry, application or donation through the Website, we may reply to you electronically about it, and you agree that electronic communications satisfy any legal requirement that such communications be in writing. This is not consent to marketing: we send marketing only if you ask for it, for example by subscribing to our newsletter, and you can unsubscribe at any time, as set out in our Privacy Policy.
16. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of the Republic of South Africa, and you submit to the jurisdiction of the South African courts.
17. Severability and Entire Agreement
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply. These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding your use of the Website.
18. Changes to These Terms
We may update these Terms from time to time. The latest version will always be available on this page, with the effective date shown at the top. Your continued use of the Website after any change means you accept the updated Terms.
